Irony - Mexican party style

Had fun on Tres de Mayo, but had an interesting dilemma.  I was drinking at my usual pace.  The wife, having not drank in months due to baby-related activities, had a beer and a margarita.  A few hours passed and restless kids were forming at the babysitters’.

So who drives?  The guy who clearly is sober but has higher than .08 blood-alcohol?  Or the woman who is clearly under .08 but is feeling tipsy?  Of course the irony is in the fact that common sense was flying in the face of the law, nonetheless, the correct answer is neither.

We let the children be unhappy for another hour until the wife’s head was clear.

That was the only way either one of you could have completely avoided the chance of a DUI.

You being over .08 is easy.

But .08 is only the per se limit. If you blow a .08 or above, you’ve got a DUI. But you can get a DUI under .08 as well. If you have any alcohol in your system you can be given a DUI, it just becomes the prosecutor’s burden to prove that whatever level of alcohol you had had impaired you.

Good ending. I forgot about the under .08 DUI loophole. I guess its never really applied to me before.
